{"id":1017,"date":"2022-07-13T09:06:04","date_gmt":"2022-07-13T01:06:04","guid":{"rendered":"https:\/\/shahalamforest.org\/wp\/?p=1017"},"modified":"2022-07-13T21:13:14","modified_gmt":"2022-07-13T13:13:14","slug":"public-inquiry-still-required-for-bukit-cherakah-forest-reserve-excision-the-star-july-2022","status":"publish","type":"post","link":"https:\/\/shahalamforest.org\/wp\/public-inquiry-still-required-for-bukit-cherakah-forest-reserve-excision-the-star-july-2022\/","title":{"rendered":"\u2018Public inquiry still required for Bukit Cherakah forest reserve excision\u2019 &#8211; The Star &#8211; July 2022"},"content":{"rendered":"<p>[vc_row][vc_column][vc_column_text]Our much loved Shah Alam Community Forest was highlighted by Malaysia&#8217;s English daily, The Star on 13th July 2022.[\/vc_column_text][vc_column_text]THE Shah Alam Community Forest (SACF) Society says it cannot accept the Selangor Forestry Department\u2019s explanation on Bukit Cherakah Forest Reserve\u2019s excision process.<\/p>\n<p>\u201cIf the excision process had been put on hold until this year, then the requirement for holding the public inquiry must still apply,\u201d said the society.<\/p>\n<div class=\"sasStoryRectPos\"><\/div>\n<p>Department director Datuk Ahmad Fadzil Abdul Majid, in StarMetro\u2019s report on July 11, had said that a public hearing was not required as the process for the excision of the forest reserve started before the enactment.<\/p>\n<p>He said that Section 11 of Enactment (Adoption) 1985 to the National Forestry Act 1984 requiring a public hearing was instituted in 2011, while the degazettement of the forest reserve started around 1991 and was pending from 2006.<\/p>\n<p>He added that the degazettement on May 5 this year was backdated from 2006 in line with the decision of Selangor state executive council in 2000.<\/p>\n<p>\u201cWe reject this explanation as the land covering 406.2ha includes a wildlife corridor that we proposed as Shah Alam Community Forest,\u201d said SACF Society.<\/p>\n<p>\u201cThe forest is vibrant. It is home to endangered species of wildlife, including tapir, gibbons and hornbills.&#8221;[\/vc_column_text][vc_column_text]\u201cWe estimate that there are at least three tapir living in that forest, based on photographic evidence from last February,\u201d it highlighted.<\/p>\n<p>\u201cOur lawyers have advised us that there is no provision in the forestry law that allows the backdating of excision notifications,\u201d said SACF Society in its statement.<\/p>\n<p>\u201cThe legal requirement to replace the excised area, which has been in force since 1984, was also not addressed,\u201d it added.<\/p>\n<p>SACF Society also noted what had been said by Selangor tourism, environment, green technology and Orang Asli affairs committee chairman Hee Loy Sian last year.<\/p>\n<p>On Oct 23, 2021, StarMetro reported Hee as saying that part of SACF had been degazetted with land titles issued to developers.<\/p>\n<p>He had said that if the plots of land had not been degazetted, land titles could not have been issued.[\/vc_column_text][vc_column_text]Read the full article on <a href=\"https:\/\/www.thestar.com.my\/metro\/metro-news\/2022\/07\/13\/public-inquiry-still-required-for-bukit-cherakah-forest-reserve-excision\">The Star<\/a>.
